| 摘 要： | 著作权集体管理组织应是不以营利为目的的民间团体,其管理的权利范围应仅限于著作权中的财产权利,著作权集体管理组织与著作权人或者与著作权有关的权利人之间在法律关系上一般是一种信托关系。在我国,建立和完善著作权集体管理组织是著作权法律制度对作品传播的市场份额进行合理分配、从而实现作者利益与社会公众利益间平衡的必由之路。

| Abstract: | With the rights management restricted to the property rights of copyright, the copyright collective management society should be an voluntary body without any profitable aim. It is a kind of entrustment relationship between the copyright collective management society and copyright holders or right holders related to copyright. In China, establishing and perfecting copyright collecting society is the only way to realize the balance between the interests of authors and that of the public. |
