Rules for activities in outer space are agreed upon in the Committee on the Peaceful Uses of Outer Space of the United Nations. Several international treaties have been adopted in the 1970s, that is, at a time before space debris became a concern for the international community. In the years 1979–1988 numerous documents were prepared by the UN Secretariat on space debris, but no official discussions of the problem were initiated by states members of the COPUOS. First proposals for introducing the matter to the UN appeared around 1988, after important studies on the subject were published by states and leading intergovernmental organizations. Also the International Telecommunication Union became concerned about the proliferation of space debris in the geostationary orbit and adopted in 1993 a recommendation to restrict the generation of debris and to re-orbit satellites approaching the end of their active lives into disposal orbits beyond the belt populated by active satellites. In 1994, the UN started discussing scientific and technical aspects of space debris. In the following years, with the assistance of experts from prominent space agencies, it elaborated a Technical Report on space debris. Legal aspects of the problem have not yet begun being discussed because the necessary consensus among states members of the COPUOS has not yet been achieved. The Global Exploration Roadmap (GER) is driven by several goals and objectives that include space science, the search for life as well as preparatory science activities to enable human space exploration. The Committee on Space Research (COSPAR), through its Commissions and Panels provides an international forum that supports and promotes space exploration worldwide. COSPAR's Panel on Exploration (PEX) investigates a stepwise approach of preparatory research on Earth and in Low Earth Orbit (LEO) to facilitate a future global space exploration program. We summarize recent activities and workshops of PEX in support of the GER.  相似文献

The 2014 session of the Legal Subcommittee (LSC) of the United Nations Committee on the Peaceful Uses of Outer Space (UNCOPUOS) saw a particularly extensive and thorough debate on the working methods of this forum, which has the status of the highest body in space law making. By discussing the working methods it also became apparent how delegations actually regard the LSC and what expectations they have from it. In a time of considerable changes in space activities and space diplomacy alike, it was only a matter of time that such a comprehensive discussion arose. And while it did not immediately lead to decisions, it provided numerous signals for the future of the LSC.  相似文献

The envisaged future space research programmes, whether in the field of space exploration or Earth observation are becoming more and more technically complicated and so costly that a single nation can hardly afford to realize them. Major non-European space-faring nations, China and India will progressively play an important role besides US, Russia and Japan. The Space Advisory Group of the European Commission recommended that the European Commission supports within Horizon 2020 a comprehensive Robotic Mars-Exploration Programme under European leadership that should become an essential element of a coordinated international space research programme. The International Space Station (ISS) experience shows that cooperative space programmes build links between industries and laboratories from around the world, which then further develop in non-space related activities, with positive impact on the economy and scientific research. Strategies need to be developed to mitigate the gradual increasing risks incurred by climate change. In order to lower their entry barrier to engage in space emerging and developing space nations need to be included in cooperative space programmes. We present the recommendations of the Space Advisory Group of the European Commission concerning Europe's participation to global space endeavours.  相似文献

Europe is present in robotic exploration though the European Space Agency?s mandatory space science program and the optional Aurora program. In addition some member states are also involved in projects of non-European space faring countries through bilateral co-operations. Europe is also present in human exploration through the ISS utilization program. ESA and some of its member states participate in the activities of the International Space Exploration Coordination Group (ISECG), a club of 14 space agencies working for the elaboration of a global exploration roadmap. Finally, ESA and the European Union have initiated a political approach with the setting up of an international forum so as to elaborate a commonly agreed vision on space exploration at political level.  相似文献

Space systems are essential to the global economy and security. The possibility of disruptions arising from competition between the United States and China through the testing and deployment of weapons in space has led to concerns over an incipient space arms race that would threaten satellites, leading to international calls for a space arms control treaty. The paper presents a rationalist theory analysis on the lack of progress in establishing such a treaty, identifying the United States' position of primacy in the global order and its preeminence in space as a primary cause.  相似文献

文章通过对空间碎片国际机制(多边谈判机制)的分析,指出其发展趋势,从而为中国参加相关谈判工作提供参考。空间碎片国际机制的发展已呈现出明显的政策化、法律化和制度化的趋势。无论是从外空利益争夺、外空战略实现,还是从中国航天事业可持续发展、中国航天立法体系完善的角度来讲,积极参加空间碎片技术合作与规则制定的国际谈判都具有重要意义。从国内建设上来看,中国应尽快制定“技术—政策(战略)—法律”三位一体的解决思路和具体方案;从国际层面看,可以借鉴美国一直坚持和贯彻的“技术—政策—国内规则—国际软法—国际法”外空策略,来开展空间碎片减缓和清除等方面的技术与规则制定的合作。  相似文献

This article addresses some issues which, although implicit in the Report, are not discussed in detail therein. The role of space science and related scientific research is particularly emphasized. Close attention is paid to the role of human factors, such as the motivation to conduct research, the motivation to engage in international cooperation, and the motivation to utilize and exploit space. The question is: should the United States and nations at large pursue a human spaceflight program (and if so, why)? I offer an unwavering positive answer to this question, and state the reasons for it while considering the broad challenges and benefits of (human) spaceflight. Space exploration is a human activity that is intrinsically forward-looking, and as such, has positive potential. Both national and international space programs can galvanize the population, inspire the youth, foster job-creation, and motivate the existing workforce. The nature of the enterprises involved—their scale, novelty, and complexity—requires a steady and continuous upward progression toward greater societal, scientific and technological development. That is, in order to overcome the challenges of human spaceflight, progress is required. More to the point, the survival of humanity depends on expanding beyond the confines of our planet. Human spaceflight, in short, presents us with an opportunity to significantly advance the nation and the global community.  相似文献

Outer space is an area of growing economic and technological importance. It is also a developing theatre of military defence and warfare. Against this backdrop, development of a legal framework on the use of force in outer space is of critical urgency. This paper proposes a framework for the development of international law in this area and also assesses the effectiveness of the current state of international law governing the prohibition on the use of force in the context of outer space. It expands upon a proposed role for the United Nations and outlines a proposed enforcement mechanism for the law on the use of force in outer space. This proposed framework rests on a three-tiered system involving an International Tribunal for Outer Space, an International Space Surveillance Agency and an International Space Inspection Agency, co-ordinated through a Secretariat under the auspices of the United Nations Office of Outer Space Affairs. The paper also provides a proposed Protocol on International Peace and Security to the 1967 Outer Space Treaty as a means of establishing the proposed enforcement mechanism. Finally, the paper looks at the complexities involved in developing the law, and moots immediate steps for its development.  相似文献

The European Space Agency (ESA) is pursuing an independent strategic planning process for consolidating a destination driven (LEO, Moon, Mars) space exploration strategy. ESA's space exploration strategy is driven by the goals to maximise knowledge gain and to contribute to economic growth. International cooperation is a key pillar of ESA's strategy as it is considered both, an enabler for achieving common goals and a benefit, opening new perspective for addressing future challenges. The achievement of ESA's space exploration strategy is enabled through international partnerships. The interagency coordination process conducted within the framework of the International Space Exploration Coordination Group (ISECG) plays an important role in laying the foundations for future partnerships. It has achieved so far the development of a common vision for space exploration, a common plan for implementing the vision in the form of the Global Exploration Roadmap, as well as a common approach for articulating the value of global space exploration. ESA has been a strong promoter and supporter of the interagency coordination process conducted within ISECG and thanks to its unique expertise in international cooperation the Agency has contributed to its success.  相似文献

The first artificial earth satellite, Sputnik 1, was launched on 14 October 1957 and proceeded to orbit the Earth blithely unconcerned with the political boundaries below. It was apparent that space activities had international implications. In the United Nations, the question of space activities was first raised in 1957 in the context of the debate on disarmament. In 1958, the ‘Question on the Peaceful Uses of Outer Space’ was placed on the agenda of the General Assembly, which adopted a resolution establishing an Ad Hoc Committee on the Peaceful Uses of Outer Space (COPUOS).  相似文献

Outer space activities have evolved significantly. While they were previously the exclusive domain of a restricted number of states, now thanks to technological advances and the easing of governmental restrictions, space activities are carried out on a much larger scale and involve subjects of both a governmental and non-governmental nature. Furthermore, the commercial uses of outer space are making space business increasingly profitable and attractive to potential investors. As the economic value of outer space activities, as well as the number of space actors grows, it is nearly inevitable that international disputes related to the use of outer space will occur. Until recently, international space law contained little dedicated machinery to settle international outer space-related disputes. This absence significantly weakened the applicability and enforceability of space law and contributed to a climate of uncertainty. In order to address these issues, the Permanent Court of Arbitration (PCA) adopted the Optional Rules for Arbitration of Disputes Relating to Outer Space Activities on 6 December 2011. The PCA Space Rules represent a significant development in the field of space law because they provide a voluntary and binding dispute settlement method accessible to all space actors and modeled on the specific legal and economic characteristics of space activities. This paper describes the genesis of the PCA Space Rules, assesses their content and innovative character, evaluates their possible implications for the settlement of outer space disputes, and argues that they should be positively received by the outer space community.  相似文献

In the early years of space flight the United Nations rapidly developed the principles which now govern outer space activities. In contrast, international agencies have during the 1980s proved reluctant to confront the escalating problem of space debris, presumbly for fear of the likely expense of remedial action. The author of this Viewpoint argues that not all the necessary measures need be expensive, and even the most unpalatable would be cost effective in the long run. But concerted action is urgently needed before the problem becomes unmanageable. International discussions must be initiated through the Committee on the peaceful Uses of Outer Space without delay.  相似文献

Among the principal objectives of the Phase 1 NASA/Mir program were for the United States to gain experience working with an international partner, to gain working experience in long-duration space flight, and to gain working experience in planning for and executing research on a long-duration space platform. The Phase 1 program was to provide the US early experience prior to the construction and operation of the International Space Station (Phase 2 and 3). While it can be argued that Mir and ISS are different platforms and that programmatically Phase 1 and ISS are organized differently, it is also clear that many aspects of operating a long-duration research program are platform independent. This can be demonstrated by a review of lessons learned from Skylab, a US space station program of the mid-1970s, many of which were again “learned” on Mir and are being “learned” on ISS. Among these are optimum crew training strategies, on-orbit crew operations, ground support, medical operations and crew psychological support, and safety certification processes.  相似文献

The Association of Space Explorers Committee on Near-Earth Objects (NEOs) and its Panel on Asteroid Threat Mitigation have prepared a decision program to aid the international community in organizing a coordinated response to asteroid impact threats. The program is described in the ASE's report, Asteroid Threats: A Call for Global Response, which will be considered by the United Nations Committee on the Peaceful Uses of Outer Space in its 2009 sessions. The findings and recommendations of this report are presented here as well as some of the major implications of the complex decision-making involved in developing a coordinated international response to the challenge of protecting the Earth from NEO impacts.  相似文献

Space systems play an important role in sustaining the development, prosperity and security of many nations. As more nations become critically reliant on space systems, questions of maintaining safety and strategic stability in outer space have come to the fore. Transparency and Confidence-Building Measures (TCBMs) for outer space activities have an important role to play in providing clarity about the intentions of States and in articulating norms of behaviour in outer space. TCBMs take several forms. They may be the elaboration of basic principles related to the exploration and use of outer space, political measures related to establishing norms of conduct, information-sharing activities to improve the transparency of outer space activities, operational practices which demonstrate a commitment to mutual cooperation in outer space, or consultative mechanisms. We present an analytical framework for evaluating potential TCBMs and illustrate the application of this framework to examples of potential operational, regulatory, treaty-based and declaratory TCBMs.  相似文献
