| 摘 要： | 死刑复核程序是我国独有的一道针对死刑适用而设立的程序,从司法层面来说有着不容忽视的功能.本文以死刑复核程序的功能定位人手,立足于最高院统一收回死刑核准权,对死刑复核程序进行分析并针对死刑核准权收归最高院的决定对死刑复核程序的完善提出建议.

| Abstract: | The death penalty checking program is the only one, which is set to apply to the execution in China. It has played a very important role in the judicature field. This article begins from the positioning of function of death penalty checking program and deliv- ers the withdrawal of death penalty approval authority by the Supreme Court. It analyzes the death penalty checking program and brings forward some advice for the improvement of death penalty checking program which is taken back by the Supreme Court. |
