| 摘 要： | 对中国新刑法“告知义务”进行了深入分析,特别是从犯罪学的角度阐述了“告知义务”作为一种回归控制,在发挥其积极作用的同时也存在着潜在的致罪因素.为了减少重新犯罪,避免社会肌体遭受更大的破坏,有必要反思回归控制制度,从而尽可能控制回归控制.

| Abstract: | Making a full research of informative obligation in new revised criminal law. On the basis of criminology, the author demonstrates that the informative obligation, qua a rehabilitation control, has some potential criminal factors when it plays a positive role in our society. In order to reduce the recidivism and avoid destroying to the society,it is absolutely necessary to reflect the system of rehabilitation control so as to be master of it as well. |
