| 摘 要： | 司法独立是一项宪法原则和国际司法准则，是实现法治的要求。我国现有的法律观念、法律文化、法律制度妨碍了司法独立。因此关键的问题是要更新观念、完善法律制度。

| Abstract: | Judicial independence is a constitutional principle and an international judiciary principle. It is demanded for the rule by law. However, the present legal ideas, legal culture and legal system prevent the judicial independence. Therefore, the key problem is to update ideas and improve the legal system, which is also inevitable. |
