As one of the three former Soviet republics engaged in space activities, the Ukraine has had to formulate new national space legislation as a means of demonstrating a responsible attitude to the international security system, of harmonising its legislation with that of its international political and economic partners and of creating clear guidelines for investors. This article presents the background to the formation of Ukrainian space law, describes some of the new laws enacted and discusses these within the context of international space law. Particular attention is paid to the legal regulation of commercial activities, to dual-use issues and to the effect of international cooperation on Ukrainian space law development.  相似文献

Despite the global financial crisis, which dominated 2008 and the first half of 2009, Estonia has decided to invest in a space programme. Estonia has extensive experience in the field of astrophysics and has developed capacities in various areas of remote sensing applications. It is on its way to becoming an active ESA partner. This article examines how Estonia is setting its way as a space nation and describes the new context and the role that various bodies are playing in the process. The paper describes the vision and strategy for space activities in the country. An overview of the possible measures to be taken to support the enterprises and scientific institutions with the highest potential for space cooperation is discussed, as are various risks in making progress in the space field, and measures for overcoming these.  相似文献

This article discusses the outcomes of an April 2005 workshop held at ISU in Strasbourg. Experts sought to tailor an international co-ordination mechanism that would achieve the classical benefits of international co-operation for the unique venture of space exploration. The mechanism they developed provides a permanent forum for those with vested interests in exploration (currently space agencies in key spacefaring nations) to exchange information about national plans and activities so as to build confidence in one another's programs and, to the extent they choose, to develop beneficial interdependencies. The product of this co-ordination effort would be a consolidated international exploration roadmap that would both inform and reflect national program decisions. The co-ordination mechanism would simultaneously involve, but in less central roles, other important interested parties (industry, the science community, other countries without current exploration programs), whose advice is important to the development of a consolidated roadmap. Recognizing that the stakeholders in exploration will almost certainly evolve over time, the mechanism also presents the flexibility to accommodate new players (e.g. companies and countries not yet with investments in exploration) in more central roles as they become stakeholders with vested interests in exploration.  相似文献

Has the current US space policy improved the USA's overall strategic position? Does it affect favorably international partnerships? These questions are examined in terms of security, political economy, and influence. In today's context, where there are more space players, more options, more potential for unintended consequences, and higher stakes, unilateral action is more limited in its effectiveness than in earlier times. Surveying current US space policy, it is not clear that data-driven, analytically based decisions are being made to affect positively national independence, innovation, market creation, and international perceptions of the USA as a trustworthy partner. More promising are the steps taken to bolster a predictable space operational environment and economic competitiveness. Ultimately, in order to achieve American excellence and leadership, a ‘closed loop’ on the policy system is needed, to gauge regularly and systematically whether the US is achieving the desired national outcomes.  相似文献

Korea now has a rapidly expanding space programme with exploration aspirations. The government is giving priority to the aerospace industry and, to put it on a better footing, recently enacted a New Space Exploitation Promotion Act. The early history and current and future development of Korea's space activities are briefly described in advance of a comprehensive presentation of the contents of the Act, including launch licensing, liability, registration of space objects, use of satellite information, astronaut rescue, third party liability insurance and establishment of institutions and plans to assist the Korean space effort. A call is made for Asian countries to unite and further their space development through a regional space agency.  相似文献

The envisaged future space research programmes, whether in the field of space exploration or Earth observation are becoming more and more technically complicated and so costly that a single nation can hardly afford to realize them. Major non-European space-faring nations, China and India will progressively play an important role besides US, Russia and Japan. The Space Advisory Group of the European Commission recommended that the European Commission supports within Horizon 2020 a comprehensive Robotic Mars-Exploration Programme under European leadership that should become an essential element of a coordinated international space research programme. The International Space Station (ISS) experience shows that cooperative space programmes build links between industries and laboratories from around the world, which then further develop in non-space related activities, with positive impact on the economy and scientific research. Strategies need to be developed to mitigate the gradual increasing risks incurred by climate change. In order to lower their entry barrier to engage in space emerging and developing space nations need to be included in cooperative space programmes. We present the recommendations of the Space Advisory Group of the European Commission concerning Europe's participation to global space endeavours.  相似文献

New, innovative joint safety policies and requirements were developed in support of the Shuttle/Mir program, which is the first phase of the International Space Station program. This work has resulted in a joint multinational analysis culminating in joint certification for mission readiness. For these planning and development efforts, each nation's risk programs and individual safety practices had to be integrated into a comprehensive and compatible system that reflects the joint nature of the endeavor. This paper highlights the major incremental steps involved in planning and program integration during development of the Shuttle/Mir program. It traces the transition from early development to operational status and highlights the valuable lessons learned that apply to the International Space Station program (Phase 2). Also examined are external and extraneous factors that affected mission operations and the corresponding solutions to ensure safe and effective Shuttle/Mir missions.  相似文献

This paper offers an approach and methodology to defining standards, centered on process/product analysis and the premise that an effective process is a good standard. The paper then discusses the role effective processes have in integrating ISS process/product infrastructures into a customer/market focused Integrated Product and Data Environment (IPDE). This article outlines the principles upon which international space law is based. Space law has been successful so far in benefiting the developing countries without hampering the spacefaring nations. The principal treaty provisions that are of special interest to developing nations are discussed, and issues associated with remote sensing, communications and environmental harms are examined in detail. Since 1967 there has been a sharp change in the focus of legal concern towards ‘taking into account the particular needs of developing countries’, a principle that will be central to arrangements for the equitable sharing of the benefits of exploiting the space environment and its natural resources.  相似文献

Cooperation is a major theme of international space law but the law and history also recognize the existence of competition and conflict. What are the trend lines in terms of promoting collective goods, commercialization and new military uses of space? An overview of selected major laws and policies, as they relate to cooperation, competition and conflict, combined with a theoretical examination of game theory (zero-sum and non-zero sum games), will enable us to obtain an overall understanding of the space age and the choices that space lawyers and policy makers face in the future.  相似文献

From the start of the 20th century, a strong tradition of collaboration has developed in the physical sciences. World War II and the following period changed this situation with a quickening of the pace of application. Thus, while basic research continues to benefit from collaboration among scientists worldwide, the increasingly complex background in which science evolves, through higher implementation costs and more difficult approval processes, renders collaboration among nations ever more pressing. Space science, with its comparatively high access cost but large fundamental importance, substantial public appeal and outstanding ability to motivate young people, shares this need. This article focuses on a recent ESSC-ESF study undertaken to improve the effectiveness of such cooperative efforts. Related findings and recommendations are presented along with a proposed operational structure for their implementation.  相似文献

This article examines the possible avenues of cooperation in space activity between nations of the Pacific Basin. It looks at possible memebers of a regional space organization and their areas of common interest. The European Space Agency is suggested as a model, and some of the useful lessons that could be learned from it, as well as significant differences between the European and Pacific regions, are discussed.  相似文献

In announcing a new Vision for the US space program, President George Bush committed the USA to “a long-term human and robotic program to explore the solar system”, via a return to the Moon, leading to exploration of Mars and other destinations. He also stated that other nations would be invited to join the vision. Many other nations have, or are developing, ‘exploration visions’ of their own. The potential for international cooperation therefore exists, both at the vision and program/project levels. This paper, based on Working Group discussions as part of an AIAA space cooperation workshop,1 presents an approach for maximizing the return on all global investments in space exploration. It proposes an international coordination mechanism through which all these various national activities could be integrated into an inherently global enterprise for space exploration, a ‘virtual program of programs’. Within the context of the coordination, individual activities would utilize the full range of cooperative mechanisms for implementation. A significant benefit of this mode of conducting cooperation is that it would not require the negotiation of complex overarching international agreements as a precondition for initiating international activity.  相似文献

For several years there has been substantial growth in the ‘nationalist’ nature of space programmes around the world, traditionally focused on unaligned useful space applications. It seems that China, India, in the future South Korea, Malaysia and others will set themselves objectives of a more political colouring symbolising national pride in their programmes. At the same time, some countries, like Iran, make no attempt to hide their plans to have their own space defence capabilities. The absolute pre-eminence of the USA, Russia and Europe is starting to fade. For emerging countries space resources are becoming an integral component of their strategic position or an asymmetrical capability aimed at weakening the credibility of advantages held by potential rivals. This article examines the new context and the role that various countries are playing in it. It is how space policies should be determined in order to understand their politico-strategic determinants and to highlight their characteristics. Nevertheless, the competitive spirit is not the only possible way. Permanent space infrastructures could also be organised globally, as ‘global public goods’, to contribute to answering questions related to major issues facing humanity.  相似文献

Based on a joint study initiated in 2007–2008 by the Policy planning staff (CAP) of the French Foreign Ministry and the space agency CNES, which brought together experts, researchers and industry insiders, this article considers the factors behind Russia's recent resurgence and the possible revival of its space programme. It examines how far the latter will require international cooperation in order to progress further and discusses likely areas of profitable collaboration with Europe in general and France in particular, given that country's long history of space cooperation with Russia and the need in the mid-term future to share the burden of developing ambitious new space programs. While there is in principle much potential, especially in the area of space transportation, there are also numerous challenges and uncertainties. How these are resolved will affect the level and success of any cooperative efforts of both sides.  相似文献

This paper examines the use of remote sensing satellites for verification in public international law. Verification always depends on the specific agreement or mission to be verified. There are no general framework rules: the means of verification and the verifying authorities vary from agreement to agreement and from mission to mission. Rapid technological development and the intensifying international cooperation have led to an increasing number of international verification missions. Whereas, in the past, verification was at the heart of intelligence and national services, the commercialization of the remote sensing industry and the information revolution have supported the creation of joint initiatives in this field. Traditionally, verification is associated with disarmament and arms control treaties, but the paper will underline that this is only one field of application for verification missions. It is important to note that there is no binding international regime specifically addressing such activity. The lack of legal certainty in this field also applies to the use of remotely sensed data as evidence in legal proceedings.  相似文献

This article is a synthesis of interviews with women working and writing in the areas of space law and policy. One initial focus of the interviews was to explore whether, as a result of the growing numbers of women working in aerospace-related fields, there might be certain women's agendas developing as well. Taken together, the responses of the 10 women interviewed clearly acknowledge the importance of the feminine perspective, while rejecting the appropriateness or necessity of concentration on specific ‘women's issues’ and favouring cooperative efforts to address problems of global concern.  相似文献

This paper argues that a better understanding of strategic decision making processes in different space agencies is relevant to the successful carrying out of international cooperative undertakings in space and that this kind of information should be taken into account when decisions are to be made on engaging in a new partnership. In this context, the paper provides a general framework for the study of strategic decision making in space organisations, with particular emphasis on the influence of culture. Additionally, it offers practical examples of how differences in policy priorities, decision making environments and practices amongst space organisations can affect international cooperative endeavours. A particular concern is with the role of national and corporate cultures in creating and reflecting differences between space agencies. In order to gather information on strategic decision making processes in the space sector, a series of 30 interviews was conducted with top decision makers from NASA, ESA and the space organisations of Brazil, France, Canada, Russia, The Netherlands and the UK.  相似文献

The increased heterogeneity of International Space Station (ISS) crews′ composition (in terms of nationality, profession and gender) together with stressful situations, due to space flight, can have a significant impact on group interaction and cohesion, as well as on communications with Mission Control Center (MCC) and the success of the mission as a whole. Culturally related differences in values, goals, and behavioral norms could influence mutual perception and, thus, cohesive group formation. The purpose of onboard “Interaction-Attitudes” experiment is to study the patterns of small group (space crew) behavior in extended space flight. Onboard studies were performed in the course of ISS Missions 19–30 with participation of twelve Russian crewmembers. Experimental schedule included 3 phases: preflight training and Baseline Data Collection; inflight activities once in two weeks; post-flight measurement. We used Personal Self-Perception and Attitudes (PSPA) software for analyzing subjects′ attitudes toward social environment (crewmembers and MCC). It is based on the semantic differential and the repertory grid technique. To study the content of interpersonal perception we used content-analysis with participation of the experts, independently attributing each construct to the 17 semantic categories, which were described in our previous study. The data obtained demonstrated that the system of values and personal attitudes in the majority of participated cosmonauts remained mostly stable under stress-factors of extended space flight. Content-analysis of the important criteria elaborated by the subjects for evaluation of their social environment, showed that the most valuable personal traits for cosmonauts were those that provided the successful fulfillment of professional activity (motivation, intellectual level, knowledge, and self-discipline) and good social relationships (sociability, friendship, and tolerance), as well. Post-flight study of changes in perceptions, related to Real Self-image, did not reveal significant differences between the images of Russian crew-members and representatives from foreign space agencies. A certain difference in perceptions was found in cosmonauts with more integrated system of evaluations: after space flight they perceived foreign participants as “closer” to their Ideal, while Russian crew-members were perceived mostly as “distant” from Ideal Self of these subjects. Perceptions of people from Earth were also more critical. These differences are likely to be manifestations of interpersonal perception stereotypes. Described patterns of changes in perceptions of cosmonauts, who have performed space flight as a part of ISS multinational crew, allow us to suggest the recommendations for development of ISS crew training, in particular, it seems useful to increase the time of joint training for deepening of intercultural interaction.  相似文献
