| 摘 要： | ＂金华＂商标与＂金华火腿＂地理标志的纠纷历经20年终于尘埃落定,这场纠纷背后所体现的地理标志保护的制度问题却不容忽视。现存的双轨制管理体系的局面需要尽快解决,商标局成为主管机关更有利于对地理标志的保护和规范,但是简单借助集体商标和证明商标的做法也存在诸多问题,在《商标法》之下建立独立的地理标志保护体系在当今是适合我国地理标志的一种保护模式。
