知识产权私权保护与公权规制的利益平衡

知识产权由于客体的非物质性特征，呈现出与所有权不同的属性，其在私权领域内的非理性扩张影响了社会的公共利益，有悖于权利保护的初衷。为了防止私权的过度泛滥，政府部门对知识产权采取了相应的规制措施。建议通过权利主体、政府部门以及行业组织三者的共同努力，协调好知识产权私权保护与公权规制之间的平衡问题，以期促进知识产权法律体系的健康、有序发展。

Interest Balance between Intellectual Property as Private Right Protection and Public Right Regulation

Due to the immaterial characteristics of the object, intellectual property shows attributes differing from those of the ownership right. The unreasonable expansion of intellectual property, which impacts the social public interest, goes against the original purpose of right protection. Aiming at pre- venting excessive abuse of private right, the government takes corresponding measures to regulate intel- lectual property. This paper, in the hope of promoting healthy and orderly progress of the intellectual property law system, views that the problem of balancing between intellectual property as private right protection and public right regulation can be well coordinated by the concerted effort of the subject, gov- ernment and industry group.
