论传媒与司法的关系

传媒与司法是现代社会中的两种重要力量。传媒对司法公正有着积极的促进作用，同时也会对司法独立产生不利影响。传媒与司法的相互协作是实现司法公正的必然选择。如何实现传媒与司法的平衡，是我国法制建设亟待解决的重大理论与实践问题。文中分析了传媒与司法在宪法上的定位，阐述了两者的对立统一关系，指出传媒监督权本质上是一种私权利。最后，文章指出了案件报道是平衡传媒与司法的关系突破口。

Comment on relation of media and judicature

In modern society,media and judicature are the two important powers.There is a real possibility that media has positive influence on improving justice of the judicature,at the same time it will make negative effect on the independence of judicature.It is necessary to coordinate both of them,only in this way we will remain justice of judicature.How to balance between media and judicature is the significant theory and practical problem in our national law construction,which must be solved as soon as possible.This article analyzes the position of media and judicature in actual constitution,and sets forth the opposite and unity relation between media and judicature.The article points out that the right supervised by the media is a kind of private right in essence.In the end the article points out that case report is key to balance the relationship between the media and judicature.
