| 摘 要： | 征罚性赔偿与精神损害赔偿具有密切的立法关联，但二者的独特功能和不同的适用领域也是显见的。“惩罚性”虽然只是精神损害赔偿的附带功能，但却是精神损害赔偿与惩罚性赔偿得以互补的中介。精神损害赔偿和惩罚性赔偿制度的协调互补应当引起民事立法和学术研究的重视。

| Abstract: | Punitive damages and pay for spirit injury have consanguineous relation, and however, the individual function and the different applying field of the two are obvious. Although the main body of pay for spirit injury isn' t punitive, the punishment is the bridge of mutual benefit of punitive damages and pay for spirit injury. The reasonable collocation and harmonization between the systems of both pay for spirit injury and punitive damages should be the new task of the civil legislation and academic research. |
