The purpose of this paper is to provide an overview of the potential contribution of satellite Earth observation (EO) to implementing and ensuring compliance with Multilateral Environmental Agreements (MEAs) from the institutional and legal point of view. EO has recently been recognized as an effective means to satisfy the demand for environmental information required by MEAs; however, actual usage of EO data in MEA implementation and compliance assurance has not yet made significant progress. While EO's legal and technical characteristics appear relevant to such applications, institutional linkage and technical reliability are still missing. Further efforts to promote EO data use for MEAs are needed through initiatives that link the EO system and data supplier with decision makers in the MEA community. The Japan Aerospace Exploration Agency's (JAXA) Kyoto and Carbon Initiative may be one example of such efforts. Recent movements, such as the Group on Earth Observation (GEO), could also provide an ideal focal point for coordinating and developing globally integrated EO and data utilization systems that could facilitate MEA implementation and compliance.  相似文献

A large percentage of the public today perceives the majority of applications of Earth observation data from satellite and aircraft altitudes to be focused on the understanding and management of the renewable and non-renewable resources of the Earth and its environment. Originally conceived as a tool for gathering intelligence information, remote sensing has just fully emerged from its military womb to the public domain. Advances in the technology, a variety of indirect benefits that could be derived from space exploration, commercialization of remote sensing and the drive of the value-added companies - all of these hold promise for new opportunities for many other novel applications of Earth observation data and related information. In the advent of the more advanced, user-friendly, cost effective, and problem solving operations being championed by the private sector, particularly in the industrialized countries, it appears that the commercial future for remote sensing programmes and related information generated in the process is promising. This paper examines how the information age is influencing the metamorphosis of remote sensing technology particularly through international legal instruments and converging technologies. In spite of the progress attained to-date, of international concern is possible radio frequency interference between remote sensing satellite and communication satellite services. There is also a major knowledge gap between the providers of raw remote sensing data and the user community, particularly those interested in the new high-level information. A resolution of these issues will enhance the contributions of remote sensing to the information economy.  相似文献

This Viewpoint argues that the 1986 UN Principles on Remote Sensing have failed to anticipate the growth and broadening of the Earth observation field and are now less relevant. It traces the development of remote sensing: from a narrow government-controlled base, three distinct sectors of military, civil (i.e. public) and commercial Earth observation can now be distinguished and the latter is making images ever more widely and easily available. There has been no international effort to adjust the international legal regime to this changing environment and even the USA's remote sensing policy has basically been reactive. It is impossible now to conceive an overarching remote sensing policy and the challenge will be to shape each sectoral regime appropriately.  相似文献

Remote sensing scientists work under assumptions that should not be taken for granted and should, therefore, be challenged. These assumptions include the following:1. Space, especially Low Earth Orbit (LEO), will always be available to governmental and commercial space entities that launch Earth remote sensing missions.2. Space launches are benign with respect to environmental impacts.3. Minimization of Type 1 error, which provides increased confidence in the experimental outcome, is the best way to assess the significance of environmental change.4. Large-area remote sensing investigations, i.e. national, continental, global studies, are best done from space.5. National space missions should trump international, cooperative space missions to ensure national control and distribution of the data products.At best, all of these points are arguable, and in some cases, they're wrong. Development of observational space systems that are compatible with sustainability principles should be a primary concern when Earth remote sensing space systems are envisioned, designed, and launched. The discussion is based on the hypothesis that reducing the environmental impacts of the data acquisition step, which is at the very beginning of the information stream leading to decision and action, will enhance coherence in the information stream and strengthen the capacity of measurement processes to meet their stated functional goal, i.e. sustainable management of Earth resources. We suggest that unconventional points of view should be adopted and when appropriate, remedial measures considered that could help to reduce the environmental footprint of space remote sensing and of Earth observation and monitoring systems in general. This article discusses these five assumptions in the context of sustainable management of Earth's resources. Taking each assumption in turn, we find the following:(1) Space debris may limit access to Low Earth Orbit over the next decades.(2) Relatively speaking, given that they're rare event, space launches may be benign, but study is merited on upper stratospheric and exospheric layers given the chemical activity associated with rocket combustion by-products.(3) Minimization of Type II error should be considered in situations where minimization of Type I error greatly hampers or precludes our ability to correct the environmental condition being studied.(4) In certain situations, airborne collects may be less expensive and more environmentally benign, and comparative studies should be done to determine which path is wisest.(5) International cooperation and data sharing will reduce instrument and launch costs and mission redundancy. Given fiscal concerns of most of the major space agencies – e.g. NASA, ESA, CNES – it seems prudent to combine resources.  相似文献

This article outlines the principles upon which international space law is based. Space law has been successful so far in benefiting the developing countries without hampering the spacefaring nations. The principal treaty provisions that are of special interest to developing nations are discussed, and issues associated with remote sensing, communications and environmental harms are examined in detail. Since 1967 there has been a sharp change in the focus of legal concern towards ‘taking into account the particular needs of developing countries’, a principle that will be central to arrangements for the equitable sharing of the benefits of exploiting the space environment and its natural resources.  相似文献

Verification of arms control treaties is essential to provide adequate international confidence in treaty compliance. This Viewpoint underlines the responsibility of non-superpower countries to become more closely involved in space surveillance of treaties to which they are parties. In Canada, Paxsat research has focused on two potential applications of space-based remote sensing to multi-lateral arms control verification. The necessary technology is readily available in non-superpower countries for the Paxsat concept to be put into operation.  相似文献

A state's posture on remote sensing of the Earth by orbiting satellites varies depending upon whether it is a ‘sensing’ or a ‘sensed’ state, upon its present economic status, and upon its economic and political history. This article considers the international legal questions related to remote sensing and discusses the political aspects with special emphasis upon the views of the Third World. The author concludes that, unless Third World states and others who support them alter their views somewhat, it is probable that remote sensing of natural resources will continue without specific legal guidelines.  相似文献

There have been growing national capabilities in the observation of Earth from space and a corresponding increase in the global awareness of environmental problems. In response, within the past decade consensus has been reached with respect to the recommendations of Unispace-82, the Principles of Remote Sensing and Agenda 21 of the June 1992 United Nations Conference on Environment and Development (UNCED); the latter was convened ‘to lay the foundation for a global partnership between developing and more industrialized countries, based on mutual needs and common interests, to ensure the future of the planet’. Similarly, the framework for international cooperation in such programmes as the US-led Earth Observing system (EOS) and the International Geosphere-Biosphere Programme (IGBP) have been established. An international remote sensing system that is user-driven may be the next logical step.  相似文献

This article examines the consequences for US-Soviet relations of the wide availability of commercial remote sensing images. Both SPOT and Landsat images have recently been used, by the Western media as well as the superpowers themselves, to comment publicly on arms control controversies and environmental disasters, notably Chernobyl. Looking to the future, several scenarios involving third-party intervention in treaty compliance disputes, supported by commercial imagery, are discussed: unpleasant consequences could conceivably follow, but experience to date indicates that outcomes are most likely to foster openness and stability between the superpowers.  相似文献

This paper examines the use of remote sensing satellites for verification in public international law. Verification always depends on the specific agreement or mission to be verified. There are no general framework rules: the means of verification and the verifying authorities vary from agreement to agreement and from mission to mission. Rapid technological development and the intensifying international cooperation have led to an increasing number of international verification missions. Whereas, in the past, verification was at the heart of intelligence and national services, the commercialization of the remote sensing industry and the information revolution have supported the creation of joint initiatives in this field. Traditionally, verification is associated with disarmament and arms control treaties, but the paper will underline that this is only one field of application for verification missions. It is important to note that there is no binding international regime specifically addressing such activity. The lack of legal certainty in this field also applies to the use of remotely sensed data as evidence in legal proceedings.  相似文献

The Central and Eastern Europe are characterized by a high theoretical and scientific level in space research and technology, including remote sensing, but inexperience in practical applications. The emerging private sector lacks management experience and needs appropriate training. Other constraints are inadequate administrative structures, a lack of coordination, and an outdated technology in general. In his report on the results of a study carried out for the European Commission, consultant and emeritus professor of the International Institute for Aerospace Survey and Earth Sciences, Caesar Voûte, outlines the new forms of European and regional cooperation being promoted. Agriculture, yield prediction and agricultural statistics, land use studies, environmental monitoring and environmental management are identified as future high priority operational applications of remote sensing and geographical information systems (GIS). Current debates on the prevention of an arms race in outer space are dominated by the traditional perspective of international strategic balance. This article addresses the issue through the often-neglected lens of environmental protection, reviewing a number of environmental instruments as they relate to outer space. It argues that environmental protection, as a non-traditional element, is an instrumental impetus for arms control. The current regime leaves the door open for states to develop conventional orbital weapons and ground-based anti-satellite weapons (ASATs), which would have a significant adverse impact on the space environment. Thus the law of environmental protection is deficient in effectively protecting the space environment from pollution resulting from military activities. It is further argued that the space arms control regime should be strengthened for humanity's common interest in a sustainable space environment. Preferably an international treaty should be concluded to prohibit testing, deployment and use of space-based weapons and ASATs. These substantive obligations also conform to the requirements of safeguarding international peace and security, and the security interests of spacefaring countries.  相似文献

A strong remote sensing regime is a necessary component of any contemporary national or international energy policy. Energy is essential to the functioning of modern industrial society, and as such it is the responsibility of governments to produce sound national energy policies in order to ensure stable economic growth, ecologically responsible use of energy resources and the health and safety of citizens. Comprehensive, accurate and timely remote sensing data can aid decision making on energy matters in several areas. This paper looks at the benefits that can be realized in resource exploration, weather forecasting and environmental monitoring. Improvements in the technology of remote sensing platforms would be of great value to buyers of energy, sellers of energy and the environment. Furthermore, the utility of such information could be enhanced by efforts of government agencies to communicate it more effectively to the end-user. National energy policies should thus include investments not only in satellite system hardware to collect data, but also in the services required to interpret and distribute the data.  相似文献

This paper examines the failure of the Earth Observation International Coordination Working Group to implement an International Earth Observation System. Tracing the history of both the Group and the mission concept, it explains the political and organizational failures that took place. It shows that these failures were linked to different approaches to international cooperation in Earth observation data policy. The main points of contention existed between Working Group members, NASA and ESA. NASA favored formal and binding legal arrangements, while ESA preferred to avoid institutionalized legal commitments. Success in coordinating and harmonizing data policy on a multilateral basis for Earth observation missions is more likely to be achieved by pursuing agreement on general principles and terms of reference than by seeking specific legal agreements.  相似文献

This paper discusses whether current international and national regulation of remote sensing activities achieves a true balance between proprietary interests of producers of remote sensing data and information and the needs of the community in accessing that data and information. By subjecting remote sensing data to general copyright restrictions that are often coupled with exclusive licences, irrespective of type or use of data and/or information, the development of important secondary information markets could be negatively hampered. In the long run, over-regulating access to space data may prove counter-productive in the information age. Using examples of different modes of information dissemination currently being practised, the paper highlights the balances to be drawn between legal issues of private ownership of data and information and public good interests. It concludes with suggestions for a more coherent regulatory approach.  相似文献

Earth observation data have been acquired and stored since the early 1970 s. One of the world's largest, and most important, repositories for land satellite data is the Earth Resources Observation Systems (EROS) Data Center (EDC). It is a data management, systems development and research field center for the US Geological Survey's (USGS) National Mapping Division in Sioux Falls, SD, USA. It was established in the early 1970 s and, in 1992, the US Congress established the National Satellite Land Remote Sensing Data Archive at EDC. Although data have been acquired and stored for decades, the world's remote sensing community has only recently begun to address long-term data preservation and access. One such effort was made recently by remote sensing leaders from academia, industry and government as members of a federal advisory committee from 1998 to 2000.2 This paper provides a brief account of the Committee's work product.  相似文献

Using the global commons for “peaceful purposes” is agreed upon among states in principle but disputed in substance. While non-militarization has been superceded by the doctrine of non-aggression, the latter, as a necessary rather than sufficient condition for “peaceful purposes”, is tested to its limit by the pressing issue of space weaponization. An international treaty to plug the gaps of the Outer Space Treaty should be negotiated. This would require the prohibition of both weapons in outer space and anti-satellite weapons on Earth. The Draft Treaty on Prevention of the Placement of Weapons in Outer Space and of the Threat or Use of Force against Outer Space Objects, proposed by Russia and China at the Conference on Disarmament, is an effort in this direction. However, divided views are held on several issues arising from the draft treaty, e.g. the efficiency of the current regime of outer space law, definitions of “weapons in space” and “threat or use of force”, and verification. A primary reason for US opposition to the draft treaty are security concerns over its space assets. However, exercising the right of self-defense is excluded from the obligations of disarmament and this is explicitly affirmed in the draft treaty.  相似文献

Super View-1 satellite constellation(Super View-1 for short) is the first commercial remote sensing constellation with a resolution down to 0.5 m. It's an important part of the national spatial information infrastructure construction. It will play an important role for the global users providing remote sensing data, application solutions and remote sensing value-added services with its high-resolution and 24-hour observation capability. At present, 4 satellites of the constellation have been successfully launched and networked on orbit. The services cover surveying and mapping, land resource surveying, urban planning, agriculture, forestry, water conservancy, geological mining, environmental monitoring, defense, disaster reduction along with other traditional industries. There are also great potential applications in Mobile Internet, LBS, Smart city, insurance and other emerging professions. The successful operation of Super View-1 breaks the overseas monopoly for commercial high-resolution remote sensing satellite imagery in the China market. It's one of the major achievements in China space science and technology by actively exploring the development of commercial remote sensing markets, which is of strategic significance to the development of China remote sensing satellite business.  相似文献

The agreement on remote sensing principles adopted by the UN General Assembly in late 1986 clarified the legal framework in the international environment. Investment decisions can now be made, and the agreement thus offers an important opportunity for commercial remote sensing. Several issues are still not settled, but there is time for governments to avoid political conflict which could affect international business relations. The creation of Intelsat and Inmarsat offers a model for international cooperation in remote sensing.  相似文献

Current educational system is facing a contradiction between the fundamentality of engineering education and the necessity of applied learning extension, which requires new methods of training to combine both academic and practical knowledge in balance. As a result there are a number of innovations being developed and implemented into the process of education aimed at optimizing the quality of the entire educational system. Among a wide range of innovative educational technologies there is an especially important subset of educational technologies which involve learning through hands-on scientific and technical projects. The purpose of this paper is to describe the implementation of educational technologies based on small satellites development as well as the usage of Earth remote sensing data acquired from these satellites. The increase in public attention to the education through Earth remote sensing is based on the concern that although there is a great progress in the development of new methods of Earth imagery and remote sensing data acquisition there is still a big question remaining open on practical applications of this kind of data. It is important to develop the new way of thinking for the new generation of people so they understand that they are the masters of their own planet and they are responsible for its state. They should desire and should be able to use a powerful set of tools based on modern and perspective Earth remote sensing. For example NASA sponsors “Classroom of the Future” project. The Universities Space Research Association in United States provides a mechanism through which US universities can cooperate effectively with one another, with the government, and with other organizations to further space science and technology, and to promote education in these areas. It also aims at understanding the Earth as a system and promoting the role of humankind in the destiny of their own planet. The Association has founded a Journal of Earth System Science Education. Authors describe an effective model of educational technology developed in the Center for Earth Remote Sensing of Bauman Moscow State Technical University and based on scientific and educational organizations integration in the field of applied studies. The paper also presents how students are being trained to acquire and process satellite imagery data from Terra and Aqua satellites. It also reveals the results of space monitoring for Russia's ecologically complex regions conducted by Bauman Moscow State Technical University students in cooperation with specialists from the Laboratory for Aerospace Methods of Moscow State University named after M.
